The first and most basic mission for which the police exists anywhere in the world according to Sir Robert peel, is to prevent crime and disorder.
The above, however cannot be properly achieved without the guidance of an effective, unified and comprehensive legal, regulatory and institutional framework to check the excesses of some rather exuberant officers of the law and also to ensure that the rights of citizens are not violated in the process of apprehending cyber criminals.
The Sixth Part of the Cybercrime Prohibition, Prevention, Etc. Act enacted in 2015 under the heading: ARREST, SEARCH, SEIZURE AND PROSECUTION clearly states the laws to be followed by law enforcement officers in approaching or apprehending suspected cybercriminals.
There is also the CRIMINAL PROCEDURE ACT which expressly specified the rightful procedures for search, seizure and arrest of suspects by law enforcement officers.
The presence of the law however does not guarantee 100% compliance as there been several cases of harassment, extortion and brutality of people by law enforcement agents usually motivated by their self-centered and corrupt motives or a complete ignorance of the cyber laws present.
According to reports, people are usually harassed mainly because they are young, drive a good car, possess a good phone, have dreadlocks or dress in a rather unofficial manner.
As Nigeria gradually joins the rest of the world in adopting and implementing a Digital Economy through the use of Digital Technology, there has also been an alarming rise in the level of Criminal activity online; there is therefore the need for law enforcement agencies to harness use of Digital Technology and the knowledge of it in deterring Cybercrimes and sundry online delinquencies and within the ambits of the law through:
- Regular trainings, seminars and workshops for law enforcement officers on cybersecurity and the knowledge and application of Digital technologies in apprehending and deterring cybercrimes.
- Deployment of reporting channels for citizens reportage of erring law enforcement officers
- Creation of awareness campaigns against Cybercrimes & Sundry online delinquencies
- Creation of awareness campaigns for citizens on their rights
In order to collect & document in details, the cases of harassment & extortion of citizens by law enforcement agents in suspected cybercrime related cases, we have published a reporting tool.
The Form will collect all possible narratives from victims including a detailed description of where the incidence took place, the name of officer(s) in question, amount of money or property seized or damage incurred.
The information collected would then be used to attempt recovery of lost items (where possible) and to call erring officers to order by the appropriate authorities.
